Terms of Service

These Terms of Service (“Terms”) are a legal agreement between you and Rahul Patil, a sole proprietor based in India (“Embody”, “we”, “us”, “our”), governing your use of the Embody mobile application and the website at myembodyapp.com(together, the “Service”).
Please read these Terms carefully. By creating an account, or by downloading, accessing, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
Important highlights (these do not replace the full text below):
- Embody provides wellbeing and self-reflection content only. It is not medical, psychological, or professional advice, and it is not a substitute for care from a qualified professional. See Section 3.
- You must be at least 13 years old (or older where your country requires). See Section 2.
- Paid subscriptions, if you buy one, are billed and managed by Apple or Google and renew automatically until cancelled. See Section 7.
- The Service is provided “as is”, our liability is limited, and disputes are governed by the law of India. See Sections 12–16.
1. The Service
Embody is a wellbeing app offering personalised daily affirmations, angel-hour rituals, tarot and Vedic/Gita-inspired reflections, high-vibration sounds, and dedicated Kids and Pregnancy experiences. We may add, change, or remove features at any time.
2. Eligibility and accounts
- Age. You must be at least 13 years old (or the higher minimum age required in your country, e.g. 16 in parts of the EU). The Kids and Pregnancy modes are intended to be used by an adult. By using the Service you confirm you meet the age requirement.
- Accounts. You may sign in using email, phone, or a Google/Apple/Facebook account. You are responsible for keeping your sign-in method and device secure and for all activity under your account. Notify us promptly at admin@myembodyapp.com of any unauthorised use.
- Accurate information. You agree to provide accurate information and keep it up to date.
3. Wellbeing disclaimer — not medical or professional advice
Embody is for general wellbeing, inspiration, and self-reflection only. The affirmations, rituals, tarot, Vedic/Gita content, sounds, and any pregnancy- or kids-related content are provided for informational and entertainment purposes and are not:
- medical, clinical, psychological, psychiatric, or therapeutic advice;
- a diagnosis, treatment, or cure for any condition;
- prenatal, obstetric, or other healthcare guidance; or
- a substitute for professional advice from a qualified doctor, mental-health professional, or other expert.
Always seek the advice of a qualified professional with any questions about your health, mental health, or pregnancy. Never disregard or delay professional advice because of something in the Service. If you are in crisis or may be a danger to yourself or others, contact your local emergency services or a crisis helpline immediately. Tarot and Vedic content is for reflection and entertainment and should not be relied upon for important decisions. You use the Service and rely on its content at your own risk.
4. Licence to use the Service
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to download and use the Service for your own personal, non-commercial use. We and our licensors retain all rights not expressly granted.
5. Acceptable use
You agree not to:
- use the Service for any unlawful, harmful, or abusive purpose;
- copy, reproduce, distribute, publicly display, resell, or create derivative works from our content except as expressly allowed (see Section 9);
- reverse engineer, decompile, or attempt to extract source code, except where this restriction is prohibited by law;
- interfere with, disrupt, overload, or gain unauthorised access to the Service, our systems, or other users’ accounts;
- upload content that is illegal, infringing, hateful, harassing, sexually explicit, or that violates others’ rights, including via support attachments or custom messages;
- misuse the referral programme (e.g. fake accounts, spam, fraud); or
- remove or obscure any proprietary notices.
We may suspend or terminate your access for violations. See Section 11.
6. Your content
- Your content. “Your Content” means anything you create or submit, such as custom angel-hour messages, important dates, support messages, and attachments. You retain ownership of Your Content.
- Licence to us. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, process, and display Your Content solely to operate and provide the Service to you.
- Responsibility. You are responsible for Your Content and confirm you have the rights to submit it and that it does not violate these Terms or any law.
- Removal. We may remove content we reasonably believe violates these Terms or the law.
7. Subscriptions, billing, and free trials
Embody may offer optional paid subscriptions (“Embody Premium”). The following applies if and when you purchase one:
- Billing through the stores. Subscriptions are sold and processed by the Apple App Store or Google Play, subject to their terms. We do not process or store your payment-card details.
- Pricing. Current plans, prices, and any free trial are shown in the app before you purchase. Prices may vary by region and may change; we give notice as required.
- Free trials. If a free trial is offered, unless you cancel before it ends, it automatically converts to a paid subscription and you will be charged.
- Auto-renewal. Subscriptions renew automatically unless cancelled at least 24 hours before the period ends. Manage or cancel in your Apple ID / Google Play account settings.
- Refunds. Refunds are handled by Apple/Google under their policies; we generally cannot refund store purchases directly. Statutory withdrawal/refund rights (e.g. in the EU) still apply where required.
- Referral rewards are subject to the programme rules shown in the app and may be changed or withdrawn for abuse.
- Free features available without payment may change over time.
8. Notifications
If you enable notifications, the Service may send angel-hour and reminder notifications based on your settings. You can turn notifications off anytime in your device or app settings.
9. Sharing affirmation cards
The Service lets you create and share affirmation “cards” (images) through your device’s share options for personal, non-commercial purposes. The underlying affirmation text and design remain our (or our licensors’) intellectual property, and the Embody branding/link should not be removed.
10. Intellectual property
The Service and all of its content — including affirmations, text, designs, graphics, sounds, fonts, the “Embody” name and logo, and software — are owned by us or our licensors and protected by intellectual-property laws. Except for the limited rights granted in these Terms, no rights are transferred to you. If you believe content infringes your copyright, contact admin@myembodyapp.com with details.
11. Suspension and termination
- By you. You may stop using the Service and delete your account anytime (Profile → Delete account, or by email). Deleting your account removes your personal data as described in the Privacy Policy; we retain a minimal deletion record (hashed email, account identifier, and subscription/free-trial history) for up to 12 months to prevent misuse of free trials and promotional offers and to defend legal claims — see the Privacy Policy, Section 10.
- By us. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Service or other users. Where reasonable, we give notice.
- Effect. On termination your licence ends. Sections that by their nature should survive (including 3, 6, 10, 12–16) will survive.
12. Third-party services and app stores
The Service relies on third-party services (such as app stores, cloud hosting, and push-notification providers). Your use of the app is also subject to the Apple App Store or Google Play terms. The following Apple-specific terms apply when you obtain the app from the App Store: these Terms are between you and us, not Apple; Apple has no obligation to provide support or maintenance; Apple is not responsible for any product warranties or claims; and Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
13. Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Service will be uninterrupted, secure, error-free, or that content will be accurate or reliable. Some jurisdictions do not allow certain exclusions, so some of the above may not apply to you, and you may have additional rights under local consumer law that we do not seek to limit.
14. Limitation of liability
To the maximum extent permitted by law:
- We will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of (or inability to use) the Service.
- Our total aggregate liability for all claims will not exceed the greater of (a) the amount you paid us in the 12 months before the claim, or (b) USD 50 (or its equivalent).
- Nothing here excludes or limits liability that cannot be excluded under applicable law (such as for death or personal injury caused by negligence, fraud, or certain consumer-protection rights).
15. Indemnity
To the extent permitted by law, you agree to indemnify and hold harmless the Operator from claims, damages, and reasonable expenses (including legal fees) arising from your misuse of the Service, Your Content, or your breach of these Terms or of applicable law.
16. Governing law and disputes
These Terms are governed by the laws of India, without regard to conflict-of-laws rules. Subject to any mandatory rights you have under your local consumer-protection law, the courts located in Pune, India will have jurisdiction, and you and we agree to first attempt to resolve any dispute informally by contacting admin@myembodyapp.com. If you are a consumer in the EU/UK or another jurisdiction with mandatory protections, nothing here deprives you of the protection of the laws of your country of residence or your right to bring proceedings there.
17. Changes to these Terms
We may update these Terms from time to time. We will post the updated version with a new “Last updated” date and, for material changes, provide more prominent notice (such as an in-app message). Your continued use after the changes take effect means you accept the updated Terms.
18. General
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service.
- Severability. If any provision is unenforceable, the rest remains in effect.
- No waiver. Our failure to enforce a provision is not a waiver.
- Assignment. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
